SWORN STATEMENT AND NOTICE OF INTENTION TO HOLD MECHANIC’S LIEN (GRANDVIEW SOLAR PROJECT)

Grandview Solar Project, LLC Sol Systems, LLC Orion Renewable Energy Group, LLC (collectively, the “Owners”)

YOU ARE HEREBY NOTIFIED that Ames Construction, Inc. (“Claimant”) whose corporate address is 2500 County Road 42 West, Burnsville, MN 55337, intends to and does hereby hold a mechanic’s lien on real estate located in Spencer County, Grandview, Indiana, more particularly described below:

The Grandview Solar Project, which extends over and contains multiple parcels of land, and which contains the following parcels:

And on improvements thereon, and any ownership, equitable, and/or leasehold interests therein, all of which are interrelated parts of a common plan and development project known and identified as Grandview Solar Project in Spencer, County, Indiana (the “Project”) to secure payment of the principal amount of Nine Million Sixty-Five Thousand Four Hundred Twelve Dollars and Ninety-Seven Cents ($9,065,412.97), plus interest and attorney’s fees, all of which is owed to the undersigned Claimant by Grandview Solar Project, LLC,  1101 Connecticut Ave NW, 2nd Floor, Washington DC 20036 pursuant to a certain Limited Notice to Proceed Agreement No. 2, dated December 21, 2022, Limited Notice to Proceed Agreement No. 3, dated February 3, 2023, Limited Notice to Proceed Agreement No. 4, dated April 28, 2023, all of which were entered into as a part of an Engineering, Procurement and Construction Agreement with Grandview Solar Project, OOC (“Grandview”), for labor, materials, equipment, and/or services, including but not limited to engineering, procurement, construction services and material manufacture and supply and related labor, materials, equipment, and services, including, but not limited to design and surveying services, in connection therewith, all of which were furnished to and for improvement of the Project within ninety (90) days of the date of recordation hereof, plus any and all extra, additional, fees, and/or change work and contractual entitlements related thereto.
